Learner PermitStudents must hold a valid learner permit appropriate to the vehicle being driven. The learner permit must be available for inspection when requested and should be brought to each driving lesson.A lesson may not proceed where the student does not hold the appropriate valid permit.## 3. Lesson BookingsLesson bookings are subject to availability and are only confirmed once agreed with James Dean Driving School.Students should ensure that the date, time and agreed meeting point are correct when a booking is made.Where lessons are purchased as part of a package, individual lesson times remain subject to availability.## 4. CancellationsStudents are asked to provide more than 24 hours' notice if they need to cancel or reschedule a lesson.Where less than 24 hours' notice is provided, the full lesson fee may be charged. This policy applies because the reserved lesson time may not be possible to offer to another student at short notice.Exceptional circumstances may be considered at the discretion of James Dean Driving School.## 6. Failure to AttendIf a student does not attend a booked lesson and has not provided prior notice, the full lesson fee will be payable.Where a student misses two lessons without notification, James Dean Driving School reserves the right to decline further bookings.## 7. Late ArrivalStudents should be ready to begin their lesson at the agreed time.If a student arrives late, the lesson may still finish at the originally scheduled time so that subsequent students are not affected. The full lesson fee will normally remain payable.## 8. Instructor CancellationOccasionally a lesson may need to be cancelled or rearranged by James Dean Driving School due to illness, vehicle issues, unsafe weather or road conditions, or other circumstances outside reasonable control.Where this happens, the student will be contacted as soon as reasonably possible and the lesson will be rearranged. No cancellation charge will apply to the student where James Dean Driving School cancels the lesson.## 9. Fitness to DriveStudents must be fit to drive safely.A lesson may be refused or stopped where the instructor reasonably believes that the student is unfit to drive safely due to alcohol, drugs, medication, illness, fatigue or another condition that could affect safe driving.Where a student attends a lesson while clearly unfit to drive and the lesson cannot safely proceed, the lesson fee may still be payable.## 10. Safety During LessonsThe student must follow reasonable safety instructions given by the instructor.James Dean Driving School reserves the right to stop a lesson where the student's actions create an unacceptable risk to the student, instructor, other road users or the vehicle.Abusive, threatening or inappropriate behaviour will not be accepted and may result in the lesson being ended and future lessons being refused.## 11. EDT LessonsWhere a lesson forms part of the Essential Driver Training programme, the student must provide the information necessary to allow the lesson and their EDT progress to be recorded appropriately.Completion of EDT lessons does not guarantee that a student has reached driving-test standard.## 12. Driver Test PreparationPre-test lessons are intended to help students prepare for the practical driving test and to identify areas that may require further development.Neither completion of pre-test tuition nor any assessment provided by the instructor guarantees that the student will pass their driving test.## 13. Pre-Test Lesson & Test-Day Car HireUse of the James Dean Driving School vehicle for a driving test is available only by prior arrangement.A student wishing to use the driving school vehicle for their test must have completed a minimum of two standard driving lessons with James Dean Driving School before test day. This requirement allows the instructor to assess the student's driving, safety, vehicle control and suitability to use the driving school vehicle for the practical driving test.Completion of two lessons does not automatically guarantee use of the vehicle for the test. The vehicle will only be provided where the instructor is satisfied that the student can drive it safely and appropriately and that use of the vehicle for the test is suitable.James Dean Driving School reserves the right to decline the use of the vehicle where there are reasonable concerns regarding safety, driving ability, legal requirements, vehicle suitability or other circumstances that could make providing the vehicle inappropriate.Where possible, any such concerns will be communicated to the student as early as reasonably practicable. The current Pre-Test Lesson + Test-Day Car Hire package is €140, comprising a pre-test lesson and use of the driving school vehicle for the practical driving test.Vehicle use remains subject to instructor and vehicle availability.## 14. RefundsWhere a student has paid in advance for an individual lesson and James Dean Driving School is unable to provide that lesson, the student may choose to rearrange the lesson or receive a refund of the amount paid for that lesson. For lesson packages, any request for a refund will be considered based on the lessons or services already provided and the circumstances of the request.Any refund due will take account of lessons or services already completed.Payments relating to late cancellations or non-attendance are subject to the cancellation and no-show provisions set out above.Nothing in these Terms affects the student's statutory consumer rights.## 15. PackagesLesson packages may be offered from time to time.Purchasing a package does not guarantee particular dates or times. Individual lessons remain subject to instructor availability and must be arranged separately.Packages are for the student for whom they were purchased unless otherwise agreed.## 16.
